What is the Role of a Court Appointed Guardian?

What is the role of a court appointed guardian?  This is a question that comes up often.  Sadly many clients, families and even healthcare providers do not clearly understand the roles and responsibilities of a court appointed guardian.  A court appointed guardian can serve many roles and perform many duties.  Guardians assume a great deal of responsibility.  

 

A guardian is a person who has been appointed through a court order to manage an incapacitated individual's personal affairs. They have decision making authority for this individual and can assume responsibility for handling numerous areas such as health care decisions, finances, the sale of property, relocation, medical care, and even the selection of and admission to a nursing facility. Guardians have a fiduciary duty to act within the best interests of the person and to protect and advocate for the individual.
